"Deponent[Prescott] engaged deft [Stewart] to drive her in a taxi from W 137 St to W 131 St and on leaving the taxi, she suggested the deft call for her at 70 W 131 St which deft did and she again entered his cab and was driven about by him, who had another man seated in the front seat with him, and after havin been driven about some time, deft stopped said cab and entered the rear part where she was riding and while therein deft attempted to have intercourse with her while she was resisting him, and he removed her watch after which he drove her to her home."
