While standing at the corner of West 126th Street and Lenox Avenue, the deponent – a police officer – observed the defendants [Mauraine, Smith] “assembled with a number of others.” The officer reportedly heard the defendants say “Come on gang, here's two more windows, let's break them,” whereupon they begun to throw stones at the plate glass window of a Lenox Avenue drug store, which was smashed in the process. The defendants then ran away and were apprehended by the officer further down Lenox Avenue.
