The deponent – a police officer - “did see the defendant [King] and about 25 or 30 others congregate at 125th St. and 7th Avenue.”After being told to “move on” by the deponent, the defendant replied “I won't move for you, this is my Harlem, and we will put that Kress store out of business and punish the man that injured that child.” After announcing himself as a police officer, the group still refused to move, and the defendant “did grab hold of the billy in deponent's hand and did break the strap thereof.” According to the officer, the incident was followed by “acts of force on violence... [on] several persons and the property of others in said immediate vicinity.”
