…about 2:35am … entered a restaurant … and ordered a glass of milk. A few minutes later a co-defendant, James D Jones, entered, took a seat ata table near the cash register, and ordered a bowl of soup. The proprietor, proceeding to the rear of the restaurant to fill these orders, was followed by the prisoner who, after engaging him in conversation, pointed a .38 calibre Colt automatic pistol at him and ordered him to raise his hands. Instead of opening, the proprietor attempted to grapple with the prisoner who fired one shot at him and then backed out towards the door in an effort to escape, but a police officer who was passing entered the restaurant and captured him after the Prisoner fired a shot at him. During the fracas between the prisoner and the proprietor the co-deft stole $50 from the cash register and escaped before the arrival of the police officer.”
