Hughes joined the crowd at West 126th St and 8th Avenue, and followed it to 125th street, between 7th and 8th Avenues, where it was being dispersed by police officers. Several detectives testified to seeing Hughes throw a stone at Roge, cutting his left eye and inflicting injuries that required him to be taken to the hospital. When arrested, Hughes had stones in his pockets. He claims that they were for his own protection, and that he was attempting to prevent the crowd from breaking windows at Koch's store, where he worked.
