Deponent is informed by one Ermine Toomer of 308 W 134th and has just cause to believe the said Ermine Toomer was violently and feloniously assaulted by Frank Pope …. That said deft and Toomer were living at the address, in apt 5 that at about 9:15am on said date Toomer told deft to get out and take his clothing with him, that there after an argument ensued during the courses of which the said deft did strike Toomer woman on the body with a cane which he then and there held in his hand and thereafter did cut, sever and lacerate the skin and flesh of the body of said Toomer with the blade of a knife then and there held in deft’s hand, inflicting injuries in the back and in the chest in the vicinity of the heart, that as the result of said assault and said Toomer was removed to Harlem Hospital where she received medical attention for said injuries; that deponent is also informed by one Mary Epps that she saw the said deft attack said Toomer woman and inflict the injuries as above described with the blade of a knife then and there held in his hand, that said assault was committed by this deft, and as deponent has been informed.
