During riot, a group of men entered the haberdashery store wielding knives, threatened owner and his clerk, demolished fixtures, smashed windows, stole $2000 of merchandise. Police officer stopped a cab containing Larry at West 123rd St and 7th Avenue, questioned him about a box containing 8 shirts, arrested him when he could not explain satisfactorily how they came into his possession - he claimed he found them on the sidewalk. Store owner identified him as one of the men who had robbed the store. Newspaper reports of the event describe the store as having been looted rather than robbed; given that evidence and Larry's arrest away from the scene, the event has been categorized as looting not robbery.

The defendant [Larry], in concert with a number of others not arrested, entered the deponent's West 125th Street haberdashery “during a riot,” and “by means of force and fear and by threatening to kill the deponent and by breaking the plate glass windows and store fixtures, did take, steal and carry away... property valued about $5000.” The defendant was later arrested by a police officer, at West 123rd Street and Seventh Avenue, in possession of a quantity of gent's shirts identified as being part of the proceeds of said crime.
