The defendant allegedly had sexual intercourse with a two year old girl [Marjorie Fausten] in the basement of an apartment on St. Nicholas Ave. She had been left with a group of other children on the stairway by a ten year old girl [Marceline McConn], who returned shortly after to find her missing. Upon looking for her in the basement, she witnessed the defendant "carnally abusing" her.
