The defendant, while riding the elevator of his mother's apartment block with the deponent - a 50 year old Black man who was superintendent of the building - began cursing him with racial slurs. The deponent replied "this is not a disrespectful house", to which the defendant "[struck] deponent on the shoulder with his fist and cut him in the abdomen with a knife."
