The defendant [Burke] entered deponent Sherman’s second-hand clothing store with an unknown man, who tried on a suit of clothing before asking that it be wrapped up. The deponent then requested payment, to which the defendant pulled out a revolver and ordered him and his wife, one Esther Sherman, into a rear room, where they stole $3.75 from his pockets.
