After locking up his Seventh Avenue butcher shop for the morning, the deponent [Nieman] returned to find that the rear window of said premises had been forcibly opened, and a large quantity of meat missing. Shortly after, the defendant [Thomas] went to a West 145th Street restaurant and attempted to sell the night cook, one Edward Ham, a quantity of pork, lamb, bacon and turkey. Ham advised him that he had no money, and told him to wait until his employer arrived at the premises. Later that morning, the deponent went to said restaurant to fill out the day’s order, and discovered that the property left was that which had been stolen from his store.
