After locking up his candy store for the morning, the deponent [Gattuso] returned to find the front window broken and a quantity of cigarettes and a “malted milk machine” missing. An hour earlier, a police officer arrested the defendants at said premises. Defendant Laforgia was in the rear yard – where the malted milk machine was found – with defendant De Angelo acting as a “lookout.” Another man involved managed to flee the scene.
