On January 19, 1935, while on the rooftop of 519 West 138th Street, the defendant “did see deponent,” and “informed [her] that she was to give him the sum of $10” the following day at Times Square and 42nd Street, “or he would kill one of her sons.” The deponent met the defendant the following day, and informed him that she was unable to pay the money but would do so on the following Monday. The defendant then showed the deponent “a large butcher knife which he stated he would use on one of the sons.” The defendant was unable to meet deponent on Monday, so they met on Tuesday in front of 533 West 145th Street, where she handed over $10 cash.
