While on the corner of West 126th Street and Eight Avenue, the deponent [Rosenblatt, a fruit merchant] was approached by the defendants, who “threatened to do deponent bodily harm and also threatened to injure his property unless deponent paid them $1 per week for each cart and truck owned by the deponent.” The deponent gave the defendants $1.50 and, the following week, another $1, of which, per prior arrangement with a police officer, the deponent had noted the number. Upon being arrested, the defendants stated that they were broke and needed money, and had “been in this racket for the past two or three months.”
