While in his West 112th Street apartment, the deponent [Santiago] – in the company of one Armand Mirando – heard the front door close and, upon inspection, discovered that a radio had been stolen. The defendants [Smith, Watkins], who had gained access through the fire escape, were apprehended by the deponent some twenty minutes while attempting to get into a taxicab with said radio.
