While in bed with his wife in their West 123rd street apartment, the deponent [Massey] woke to see the defendant [Ponder] in the premises. He “did seize hold of defendant and tried to hold him but defendant broke loose and started to run.” The deponent chased him to Mt. Morris Park, at East 124th Street and Madison Avenue, where he was arrested by a police officer. On his person was found 90 cents, which had been stolen from a pocket book on the table of said premises.
