While the deponent [Atkins] was “in his room” on West 122nd Street, the defendants [Davis, Williams, Madden] entered and defendant Davis “did point a revolver at [him] and ordered him to stick up his hands.” The deponent then “seized the hand holding the revolver,” to which Davis bit his hand, while one of the other defendants grabbed hold of his throat and attempted to steal $50 cash from his clothing. The deponent's wife then came to his assistance, and was knocked to the ground, before the defendants fled the scene – to be arrested on West 124th Street for revolver possession.
