After leaving her East 114th Street apartment locked for the evening, the deponent [Torres] retuned to find the fire escape window broken open, and a radio and quantity of “wearing apparel” stolen. The defendants [Rodriques, Mercado; both Puerto Rican] were arrested four days later, at West 115th Street and Fifth Avenue, in possession of “some of the said property.” The radio was later recovered from the East 114th Street apartment of defendant Rodriguez.
