While in the West 144th Street furnished room occupied by the deponent [Smith], the defendant [Morton] “asked deponent if he was going to appear against one Hanson Johnson, who was charged with Robbery.” The deponent informed her that he intended to testify, to which the defendant “grab[bed] hold of a knife which deponent had laying upon the table… and she did then and there stab deponent twice upon the left shoulder.” The defendant made another attempt to stab the deponent, during which he “caught hold of her and bit her upon the arm… in which she held the knife, in his attempt to cause deponent to drop said knife.”
