After leaving his Eighth Avenue locked for around an hour, one John Green [who shared the apartment with the deponent, Drumeyer] returned to find “the contents of the apartment… thrown around and… the [kitchen window] forced down.” A quantity of clothing, towels, and a radio were missing from the premises. The superintendant of said building, one Eugene Hamilton, witnessed the defendant [Stewart] in the apartment some ten minutes prior. Upon checking the roof, he noticed that the “door leading from the top hall” had been unlatched. A short time later, the defendant re-entered the public hall of said apartment building and, upon being questioned by superintendent Green, “could not satisfactorily explain why he was going to the apartment.” Upon his arrested, the defendant offered to return said property if charges were dropped.
