Upon investigating
-
Upon investigating “a noise” at the West 115th Street apartment building where he worked as superintendant, the deponent [Pena] discovered “the door leading to a vacant apartment on the ground floor had been broken open.” The defendant [Figueroa, a 26 year old Puerto Rican man] was inside the apartment, in the process of “breaking the wall leading to a tailor shop in said premises.” Once spotted, the defendant fled – with the deponent in pursuit – to West 116th Street and Fifth Avenue, where he was arrested.
