Upon returning to her residence in a Seventh Avenue rooming house after having left the premises for around half an hour, the deponent [Flemings] saw the defendants [Hayes, Aikens]

Upon returning to her residence in a Seventh Avenue rooming house after having left the premises for around half an hour, the deponent [Flemings] saw the defendants [Hayes, Aikens] “coming down the stairs carrying clothes.” Once inside her room she discovered that the front door and been forced open and a quantity of clothing and personal property – valued at around $300 – were missing from said premises.
