The defendants [McNeeley, Stevenson], while acting in concert with another unknown man [Norman Roberts], entered the deponent’s Fifth Avenue drug store, where “[McNeeley] did point a fully loaded revolver at deponent.” The deponent then “made a motion” to switch on the alarm, to which McNeeley “did discharge a bullet… striking deponent in the shoulder.” The defendants fled the store, and were apprehended by police “half a block away.” According to the NY Age, Katz went for the alarm because he had been robbed 7 times in last 3 years. As the men fled they were seen by police in radio car, who chased them down 129th St, firing as they went. The police shots hit a bystander - Mrs Hattie Huddleston, 23, 40W129 - in the heel.
