The deponent [Shasshah, a salesman], while carrying a quantity of goods [including a “fibre sample case” containing women’s silk underwear, a gold wrist watch, pawn ticket and $2.90 cash] down the stairs, was accosted by the defendant [Miller] and two unidentified men, who were standing on either side of the hallway. The man “standing at the one door … placed his arm around deponent’s throat,” while the others “struck deponent about the head, face and body.” While he was lying in “a semi-conscious state,” the three men stole said property from his person.
