While on the corner of East 125th Street and Park Avenue, the defendant [Anthos] "struck deponent [Figueroa] in the right eye with an empty bottle… causing deponent to sustain the loss of said eye, which necessitated [his] confinement in Harlem Hospital for a period of five days."
