As the deponent [Govan] entered her Seventh Avenue apartment, she was “seized” by the defendants [Wade, McDonnell] – acting in concert with one Benjamin Frederick and two others not arrested – who “bound and gagged her,” before taking her to her room, where they “began to torture deponent and did take by means of force and fear [$260 cash and $375 worth of clothing and jewelry].” The assailants were holding guns at the time of the assault. Upon taking said property, the defendants told the deponent that they would wait for her husband’s return, and make him open the safe. After waiting five hours, the men left.
