While living as ‘roomers’ in deponent Garcia’s Fifth Avenue apartment, the defendants [Davis, Ogoleyskive] stole a quantity of belongings – including a guitar, mandolin, radio, dishes, and umbrella, along with clothing and $35 cash – as he slept. Some of the stolen items were later recovered from the defendants’ Seventh Avenue apartment.
