While the deponent [Davis] was in his Seventh Avenue barber shop, the defendants [Arrington, Clark] entered and “[claimed] he was running a game in the rear room… and that if he wanted to continue he must pay them [$25] for protection.” Later that day, the men returned and, after “[calling deponent] into the rear yard,” demanded the money. The deponent said he didn’t have, to which the defendants requested $5 instead. Upon his refusal, the defendants stated “You know what will happen if you don’t pay up, the same thing that happened to the others who refused to pay,” before threatening to “break up his place.”
