It was alleged that the defendants [J. Smith, P. Smith] “did point and aim a revolver” at the deponent as he was leaving the hallway of 2182 Fifth Avenue, where he was canvassing as an insurance salesman. Defendant J. Smith then searched his clothing – from which he stole $8 cash, along with a gold watch and ring – before ordering him to go back up the stairs of said building. As deponent turned around to do so, defendant P. Smith “struck [him] upon the back of the head with the gun,” before the two defendants “ran away.” The deponent later spotted the two defendants on the street, and caused their arrest, though it was found that P. Smith was in fact working at a public school on the day. The deponent also testified that the defendants were clean-shaven, although J. Smith had only just shaved his moustache of “at least six years.”
