After her husband [the deponent, Johnson] left their West 141st Street apartment locked for the afternoon, the deponent’s wife returned to find the front door unlocked, and a quantity of valuables missing. That afternoon the defendant [Biggs] was arrested by a police officer while attempting pawn a suit – which did not belong to the deponent – and found to be in possession of a pocketbook that had been stolen from said premises, which defendant claimed he had found on the street.
