One month after having a quantity of clothing – 4 suits and 15 shirts – stolen from 2194 Seventh Avenue, the deponent [Smith] witnessed the defendant [Hinton] wearing one of the said suits in the same premises. The defendant stated that his wife had given him the suit and, as the deponent “was about to cause defendant’s arrest,” ran away.
