After approaching Gerald Mariano [aged 6] – who was playing with “other children” on East 125th Street and Second Avenue – and asking for a kiss, the defendant [Bennett] offered him a penny to come up to his Wast 124th Street room. Witnesses informed a police officer, who went up to the defendant's room and discovered Mariano there “partly nude.” Upon questioning, the defendant stated that he was drunk, and admitted to having performed oral intercourse on the child.
