The defendant [Moore] was found by a police officer “crouching” in the deponent's bootblack booth – said premises having been locked by the deponent [Genticello] three and a half hours earlier. The officer discovered that the lock had been broken and, upon searching defendant, found him to be in possession of six bottles of “shoe paste” belonging to the deponent.
