The defendant [Ellis] “did take, steal and carry away,” two gold rings and loose diamonds [valued at $3,400], from the deponent’s [Taylor's] room in a West 120th Street “private house.” Five minutes after said larceny took place, the deponent accused defendant and stealing the jewelry, to which he “did strike [her] on the face with his fist, did knock deponent to the floor, and in the course of the fighting… did drop all said property from his hand.” The deponent’s nephew [Raymond Jarvis], who was also in the premises at the time, “reached for said property,” and was kicked by the defendant in the stomach. The defendant then grabbed the jewelry and “got away.”
