Defendant Carson entered the “lunchroom and poolroom” of the deponent [Amos] and ordered a hamburger sandwich. While he was eating, defendant King entered the premises and “told deponent that if he did not have his place closed by 9 p.m. he would break it up.” He then grabbed two glasses and “was about to throw them.” In the meantime, defendant Carson went to the crash register and demanded 75 cents. After the deponent refused, defendant King threatened to hit him over the head with a stool, to which deponent handed over the contents of his register [$1.75].
