While in a restaurant at West 127th Street and Lenox Avenue with some “soldier friends,” the deponent met the defendant and, after talking for a short time, was invited to accompany her to 410 Lenox Avenue “for a good time.” Upon arriving at the premises with his friends, they went to the top floor, where “2 [Black] men ran upstairs behind them and did point and aim revolvers at [them], forcing them to face the wall... and raise [their] hands.” The defendant then said that if they kept quiet they wouldn’t get hurt, and “stood alongside” while the men searched deponent’s pockets – from which they stole $1.75. One of the men then asked what the deponent was going to do “about more money,” and upon being told that that was all he had, shot him in the leg.
