While the deponent [James] was absent from her West 115th Street apartment, the defendants [Rios, Garcia, Mendez] – and two others not arrested – entered her residence and, upon her return, “pointed revolving pistols at [her] body as well as [her] relatives,” who were already inside said premises. Defendant Mendez then said to the deponent, “Where is your money,” and ordered her into the kitchen, where defendant Rios searched her clothes – from which he stole $4.27. Two others present, one William Watt and one Herman Ross, also had cash and valuables stolen.
