After being accosted by defendant Boyles, who invited him to “go with him to his place and see it,” the deponent [Shefter] went to 128 West 139th Street with a group of friends. Upon reaching the top floor of said premises, defendant Bell, who was in the company of defendant Boyles, produced a knife and “ordered the deponent and his friends to stick their hands up.” Defendant Boyles then made a gesture with his hand, “as though he had a revolver in the pocket of his coat,” before stealing $20 – and a check for $86 – from deponent’s person. A fight then ensued, during which the deponent recovered $13, along with the check.
