While walking down West 138th Street, between Lenox Avenue and Seventh Avenue, with one Thomas Terranova, the deponent was approached by the defendant [Johnson], who “acted as if he was intoxicated and pumped against deponent [and Terranova]... causing them to walk toward the hallway of [104-106 West 138th Street].” The defendant then “made a gesture... as if to say he had a revolver and ordered deponent and said Terranova to enter the hallway and go up to the top floor.” Two men then appeared, and escorted them to top floor, where the defendant – who produced a knife – robbed he deponent of his overcoat, shoes, and $7 cash.
